How Can We Help?
We have prepared this basic guide about making an Islamic Will as per the Alberta Wills and Succession Act (WSA).
Please note that you do not have to register a will in Alberta for it to be legally valid. A will is legally valid in Alberta if it meets the requirements outlined in the Wills and Succession Act, including:
• Being in writing (typed or handwritten).
• Signed by the testator (the person making the will).
• Signed in the presence of two adult witnesses (unless it is a holographic will, which does not require witnesses).
While registration is not required, Alberta offers a voluntary will registration service through the Registry of Wills at the Vital Statistics Office. This service does not store the will itself but records its existence and location, making it easier for your executor to find after your passing.
Where Should You Store Your Will?
• Keep the original will in a safe place (e.g., a fireproof box, a lawyer’s office, or a safety deposit box).
• Ensure your executor knows where to find it.
